Eminent Domain Watch --------

In the United States, the Fifth Amendment to the Constitution requires that just compensation be paid when the power of eminent domain is used, and requires that "public purpose" of the property be demonstrated. Over the years the definition of "public purpose" has expanded to include economic development plans which use eminent domain seizures to enable commercial development for the purpose of generating more tax revenue for the local government.

We'd also like to quote SCOTUS Justice Sandra Day O'Connor :In her dissent a couple weeks back now, Justice Sandra Day Oâ€™Connor said the decision bowed to the rich & powerful at the expense of the little guys, middle-class Americans.
"The specter of condemnation hangs over all property," Oâ€™Connor wrote. "Nothing is to prevent the state from replacing any Motel 6 with a Ritz-Carlton, any home with a shopping mall, or any farm with a factory."
